Ms. President of the Patent Office of the Republic of Poland on February 28, 2023. signed a notice of designation of an exhibition giving priority to obtain a right of protection or a right of registration, when exhibiting a utility model or an industrial design therein.
The notice in question was published in the Monitor Polski of March 7, 2023 in item 254 (copy of the notice attached).

Please note that there are a number of requirements before “exhibition priority” documents from the Polish Patent Office:

I. Proof of priority resulting from the exhibition of an industrial design shall include:

1. 1. a certificate from the exhibition manager stating that an industrial design has been exhibited at a given exhibition; the certificate shall contain the surname and first name or the name of the exhibitor, the name, duration and place of the exhibition, the date of exhibition of the industrial design and a statement of the identity of the exhibited object with an attached illustration of the object
   2. illustrations of the exhibited object, revealing its essential features, certified by the exhibition manager in a manner that does not raise doubts about the authenticity of the content of these documents
   3. document stating the nature of the exhibition

Proof of priority may include several varieties of a design if all of these varieties were exhibited at the exhibition. If the subject of the industrial design is a textile product, the proof of priority may additionally be accompanied by textile samples certified by the exhibition manager.

II. Proof of priority resulting from the issuance of a utility model should include:

1. 1. a certificate from the exhibition manager stating that the utility model was exhibited at the exhibition in question; this certificate should contain the exhibitor’s name and surname or the name of the exhibitor, the name and city, the duration of the exhibition, the date of exhibiting the utility model, as well as a statement of the identity of the exhibited object with the attached description and drawing of the object
   2. description and drawing of the exhibited object, revealing its essential technical features, certified by the exhibition manager in a manner that does not raise doubts about the authenticity of the content of these documents
   3. A document stating the nature of the exhibition.

Accordingly, an exhibitor who intends to exercise its priority right from the ENERGETAB 2020 exhibition is requested to prepare the relevant documentation and notify ZIAD in advance of such intention, so that a date can be arranged for a meeting with the patent attorney representing the Fair Organizer and verifying the documents and subject matter presented by the Exhibitor.
